These Terms of Service ("Terms") govern your access to and use of the RefriTech Pro mobile application and related services (collectively, the "Service") provided by RefriTech Pro ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and the organization.

We reserve the right to modify these Terms at any time. Material changes will be communicated through the app or by email at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

2. Description of Service

RefriTech Pro is a mobile field service and diagnostic platform designed for industrial refrigeration professionals. The Service includes a probability-ranked diagnostic engine, pressure-temperature calculators, client and equipment management, maintenance checklists, relief valve tracking, photo documentation, and emergency safety references.

The Service is available as a mobile application for iOS and Android devices. Certain features require an active internet connection for data synchronization, while core diagnostic, safety, and calculation features are available offline.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to create an account. The Service is designed for use by qualified industrial refrigeration professionals and is not intended for consumer or residential use.

4. Subscription and Billing

RefriTech Pro offers Free, Pro, and Enterprise subscription tiers. The Free tier provides limited access to diagnostic features at no charge. Pro and Enterprise tiers require a paid subscription.

Auto-Renewal: Paid subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled at least 24 hours before the renewal date. Renewal is charged at the then-current subscription rate.

Cancellation:You may cancel your subscription at any time through the app or your device's app store subscription management. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of that period.

Refunds: Subscription fees are non-refundable except as required by applicable law or the policies of the Apple App Store or Google Play Store. If you believe you are entitled to a refund, contact us at support@refritechpro.com.

Price Changes:We reserve the right to change subscription prices with 30 days' notice. Price changes apply at the next renewal date after the notice period.

5. Intellectual Property

The Service, including its diagnostic content database, software, design, text, graphics, and all other materials, is owned by RefriTech Pro and protected by copyright, trademark, and other intellectual property laws.

The diagnostic content database — including all systems, symptoms, causes, diagnostic steps, probability ratings, and instrument recommendations — is proprietary content developed by RefriTech Pro. This content is licensed to you for personal or organizational use within the app and is not sold. You do not acquire any ownership rights to the diagnostic content.

Data you create using the Service (client profiles, equipment records, checklist completions, maintenance logs, diagnostic log entries, notes, and photos) remains your property. We claim no ownership over your data. You grant us a limited license to store, process, and transmit your data solely for the purpose of providing the Service.

6. Prohibited Conduct

You agree not to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service or its diagnostic content database
  • Extract, scrape, copy, or reproduce the diagnostic content database in whole or in part for use outside the Service
  • Use the Service or its content to develop, train, or improve a competing product or service
  • Share your account credentials with unauthorized users or allow multiple individuals to use a single-user account
  • Circumvent, disable, or interfere with any security, authentication, or access-control features of the Service
  • Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law
  • Transmit any viruses, malware, or other harmful code through the Service
  • Misrepresent your identity or affiliation when using the Service

7. Diagnostic Disclaimer

Important Notice

RefriTech Pro is a diagnostic aid and reference tool designed to assist qualified refrigeration professionals. The diagnostic content, probability rankings, suggested procedures, and safety information provided by the Service are based on industry knowledge and best practices, but they do not replace professional engineering judgment, manufacturer-specific guidelines, local building codes, or regulatory requirements.

Always follow the equipment manufacturer's installation, operation, and maintenance guidelines. Always comply with OSHA Process Safety Management (PSM) requirements, EPA Risk Management Program (RMP) regulations, IIAR standards, and all applicable local, state, and federal codes.

The probability rankings in the diagnostic engine represent general likelihoods based on industry experience. Actual probabilities vary based on equipment age, manufacturer, operating conditions, maintenance history, and environmental factors. Never rely solely on the app's diagnostic output when making safety-critical decisions.

RefriTech Pro does not provide compliance documentation, regulatory audit tools, or engineering certifications. The Service is not a substitute for professional engineering services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REFRITECH PRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Indemnification

You agree to indemnify, defend, and hold harmless RefriTech Pro and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any actions taken based on diagnostic information provided by the Service.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent or abusive activity, or extended periods of inactivity.

Upon termination, your right to use the Service ceases immediately. Data stored in our cloud systems will be retained for 90 days after termination, during which you may request a data export. After 90 days, your data may be permanently deleted.

Sections 5 (Intellectual Property), 7 (Diagnostic Disclaimer), 8 (Limitation of Liability), 9 (Indemnification), and 11 (Governing Law) survive termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Any dispute arising out of or related to these Terms that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except that either party may seek injunctive relief in court for intellectual property disputes.
